Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of Polaris AI Translation ("the Service"), a Shopify application operated by Clauma Marketing GmbH ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

2. Acceptance of Terms

By installing, accessing, or using Polaris AI Translation, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.

3. Service Description

Polaris AI Translation is a Shopify application that provides AI-powered translation services for your store content, including products, collections, pages, blog posts, and SEO metadata. The Service uses third-party AI models to generate translations and syncs them to your Shopify store via the Shopify API.

4. Account Terms

• You must have a valid Shopify store to use the Service.
• You are responsible for maintaining the security of your account and API keys.
• You must provide accurate and complete information when setting up your account.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations.
• Translate content that is illegal, harmful, threatening, abusive, or otherwise objectionable.
• Attempt to gain unauthorized access to the Service or its related systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Use the Service for any purpose other than its intended use as a translation tool.

6. BYOK API Keys

The Service operates on a Bring Your Own Key (BYOK) model for AI translation services. You are responsible for:

• Obtaining and maintaining your own API keys from supported AI providers (e.g., Google Gemini).
• All costs and charges incurred through the use of your API keys.
• Complying with the terms of service of the respective AI provider.
• Keeping your API keys secure and not sharing them with unauthorized parties.

We encrypt your API keys at rest and only use them to process translation requests on your behalf. We are not responsible for any charges incurred by your AI provider.

7. Billing & Payments

The Service offers both free and paid plans. For paid plans:

• Billing is managed through Shopify's billing system.
• Subscription fees are charged on a recurring basis as specified in your chosen plan.
• You may upgrade, downgrade, or cancel your plan at any time.
• Refunds are handled in accordance with Shopify's billing policies.
• We reserve the right to change pricing with 30 days' notice.

8. Intellectual Property

You retain all rights to your original content and the translations generated through the Service. We do not claim ownership of your content or translations.

The Service itself, including its design, code, features, and documentation, is the intellectual property of Clauma Marketing GmbH and is protected by applicable intellectual property laws.

9. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the data practices described in our Privacy Policy.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

• Translations will be 100% accurate, complete, or error-free.
• The Service will be uninterrupted, timely, secure, or free of errors.
• The results obtained from using the Service will meet your specific requirements.

AI-generated translations may contain inaccuracies. We recommend reviewing translations before publishing them to your live store, especially for critical content such as legal notices, product safety information, or regulatory disclosures.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Clauma Marketing GmbH shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Termination

You may terminate your use of the Service at any time by uninstalling the application from your Shopify store. We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice.

Upon termination, your right to use the Service will cease immediately. We will delete your data within 30 days of termination, except where retention is required by law.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in Konstanz, Germany.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.
